Direct Booking Terms & Conditions – Poets Rest (Brighton & Hove) / Rose Cottage (Hawes)
These terms form a legally binding agreement between you (the Guest) and the Property Owner, Brendan McCaul, for a short-term holiday rental at either Poets Rest or Rose Cottage, as agreed at the time of booking.
1. Booking & Payment
All booking dates and property details are arranged directly with Brendan.
Once payment is made, you agree to these terms in full and the booking is confirmed.
2. Cancellation Policy
All bookings are non-refundable, regardless of the reason for cancellation.
As a small, independent setup, we are unable to accommodate last-minute changes or cancellations.
We strongly recommend taking out travel insurance to protect against unforeseen disruptions or illness.
3. House Rules
House rules are in place to ensure a respectful and enjoyable stay for all. These are detailed in a Guest Guide shared by Brendan.
If you’d like to see the guide in advance, just ask. Otherwise, by booking, you agree to follow all house rules.
Failure to comply may result in early termination of your stay without refund.
4. Damages & Deposits
We don’t currently take a security deposit — we trust our guests and want to keep upfront costs low.
We understand that accidents happen (so please don’t sweat the odd broken glass!), but by booking, you agree to the following:
You’ll treat the property with respect and care.
You’ll report any damage, breakages, or maintenance issues during your stay.
You are legally and financially responsible for the full cost of repairing or replacing any significant damage, lost items, or extra cleaning required beyond reasonable use.
“Reasonable use” doesn’t include major spills, stains, misuse of furniture, or damage caused by pets or guests.
In serious cases, or if damages aren’t reported, we reserve the right to seek reimbursement and take legal action if necessary.
5. Liability & Insurance
Guests stay at the property entirely at their own risk.
The Owner accepts no liability for:
Accidents, injuries, or illnesses during your stay
Loss, theft, or damage to personal belongings
Travel delays, cancellations, weather events, or other unforeseen circumstances
It is your responsibility to have appropriate travel insurance in place. By booking, you accept full responsibility for yourself and all guests in your party.
6. Force Majeure
The Owner is not liable for any cancellation or disruption caused by events beyond their control, including but not limited to natural disasters, government restrictions, pandemics, or utility failures.
7. Owner’s Right to Cancel
The Owner reserves the right to cancel a booking in cases of:
Misrepresentation
Breach of house rules
Legal or safety concerns
If cancellation occurs before your stay begins, any refund will be at the Owner’s discretion.
8. Governing Law
This agreement is governed by the laws of England and Wales, and any disputes will be resolved in the courts of this jurisdiction.
By completing your booking and making payment, you confirm that you have read and accepted these terms. This agreement is legally binding, and you accept full responsibility for the conduct of all members of your group.
